Massachusetts contract law requires that an agreement have “consideration” or an exchange of value to be enforceable. Without consideration, the contract is not a valid contract. Without severance pay, regardless of its size and even if the benefits are not a cash payment, the separation agreement is not applicable. After an initial review of the agreement, you can choose to hire an employment lawyer, especially if you have evidence of discrimination, if the language of the package is too complicated or too broad, or if the agreement is several pages long. Ask the attorney what state laws govern termination agreements and whether there are any timing and payment provisions. Also talk to local employment and human resources agencies to determine how long it may take to get a new job at the same level and salary.
